When is overtime required by law?

Under the Fair Labor Standards Act (FLSA), employers must pay non-exempt employees at least 1.5× their regular rate for hours worked beyond 40 in a workweek. Some states have daily overtime rules — California requires OT after 8 hours in a day.

What is double time?

Double time means paying 2× the regular rate. While not federally mandated, some state laws (like California) require double time for hours over 12 in a day or over 8 on the 7th consecutive workday. Many employers offer it as a benefit.

Are all employees eligible for overtime?

No. "Exempt" employees (executives, professionals, administrative workers earning over $684/week as of 2024) are not entitled to overtime. "Non-exempt" hourly workers and lower-paid salaried workers generally are eligible.
